Filing of unpublished works

Filing an unpublished work is a tool of protection against plagiarism for all creations not yet made public. Through this procedure, the depositor obtains certain proof of the existence of the work, with an official date corresponding to the moment of filing with SIAE.

Among the works that may be filed, by way of example: novels, musical pieces, short stories, poems, scripts, plots, subjects, audiovisual works, software, databases and graphic works.

Software and apps

Where software or an app has an original and creative character, protection may be obtained through publication and deposit with the competent Public Register, with the resulting exercise of the exclusive rights, in particular the right of economic exploitation.

The exclusive rights granted to those who register the software or app mainly concern the power to carry out and to authorise:

• the reproduction — permanent or temporary, total or partial — of the program by any means or in any form;
• the translation, adaptation, transformation and any other modification of the software, as well as the reproduction of the resulting work, without prejudice to the rights of those who make such modifications;
• any form of distribution to the public, including rental, of the original program or copies thereof.
